1. Parties to this agreement
This User agreement (referred to hereinafter as the Agreement) contains the terms and conditions of the use of finnishdesignshop.com web service (referred to hereinafter as the Service) owned by Finnish Design Shop Oy (referred to hereinafter as the Service Provider). When a person (referred to hereinafter as the User) completes the registration process or orders product/s, he or she agrees to this Agreement.

2. Use of the Service
2.1. The Service is intended for private individuals, institutions and companies who live / which are located in the countries listed on the Service website.
2.2. Return policy does not apply to orders made by institutions or companies.
2.3. You must be eighteen or older to order products from the Service.
2.4. Everything in the Service, including images, drawings, sound, graphics and text, is protected by worldwide copyright and other proprietary laws and treaty provisions. Service Provider grants you a limited license to access and make personal use of this site, and not to download, except where specifically invited, nor to duplicate, sell or modify, any portion of this site without express written authorization from the Service Provider.
3. Registration
3.1. The User can register by filling out the registration form and choosing a username and password. To register, the User must provide his/her real name, address, phone number/ mobile phone number and e-mail address. In addition to information mentioned above, the institutional and corporate customers must include the trade registry number and VAT number.
3.2. By registration, the User warrants that he/she has read the provisions of this Agreement, agrees to these provisions and pledges oneself to comply with these provisions.
3.3. The User ordering on behalf of a company warrants that he/she has sufficient authority to order the items in question and bind that company to this Agreement.
3.4. Registration is free of any charges.
4. User responsibilities
4.1. The User accepts responsibility for all activities that occur under his/her account or password. The User is solely responsible for maintaining the security of his/her password.
4.2. The User warrants to the Service Provider that the information he/she provides during the registration process (and any notification of change of such information) is true and correct.
4.3. The User warrants that he/she is over 18 years old.
5. Privacy policy
5.1. Service Provider is committed to respecting the User's privacy as set in the European Union law of data protection and privacy. See our privacy policy.
6. Ordering and Payment Terms
6.1. When an order is placed in the Service the binding sales agreement between the User and the Service Provider is reached when the User receives an order confirmation e-mail in which the availability and estimated delivery time are confirmed.
6.2. Unless otherwise agreed by the Service Provider, payment must be received by the Service Provider prior to acceptance of an order.
6.3. Service Provider reserves the right to reject any order in its sole discretion.
7. Customer Responsibilities and Obligations Related to Interior Design Services
The Customer undertakes to provide the requested information regarding the space to be designed before the commencement of the design work. The requested information must be provided within three (3) business days from the order of the design work. If the required information regarding the space has not been received by the deadline, Finnish Design Shop cannot guarantee the promised delivery time.
The Customer is responsible for the copyrights of any images and video material submitted, as well as for ensuring that the submitted material complies with these terms, the law, and good practice. The Customer is responsible for ensuring that the material does not contain offensive content. The material must also not include any data relating to natural persons that could be considered personal data.
The Customer is responsible for verifying the suitability of the products for the Customer’s premises before ordering the Service. Finnish Design Shop is not liable for costs arising from incorrect purchases or measurement errors.
Finnish Design Shop is responsible for the content and copyrights of any material it produces, as well as for any third-party material for which Finnish Design Shop has obtained usage rights.
All rights to the plans created as a result of the Service belong to Finnish Design Shop. The Customer has no right to copy or otherwise use the results for any purpose other than private use, unless otherwise required by mandatory applicable legislation.
The Customer undertakes to cooperate in the performance of the Service. The Customer must, upon request, provide information on matters that Finnish Design Shop must take into account in the performance of the Service.
8. Product prices
8.1. The product price is the price displayed for the item on the Service at the time of ordering.
8.2. Delivery charges vary depending on the shipping destination and are stated for each order at check-out.
8.3. All the product prices are displayed in AUD, CAD, CHF, CNY, CZK, DKK, EUR, GBP, JPY, NOK, NZD, PLN, SEK, SGD or USD according to the shipping country.
8.4. Taxes and Duties
8.4.1. For the European Union countries and United Kingdom (effective 1.1.2021), all prices displayed are inclusive of VAT (Value Added Tax).
8.4.2. All non-EU countries (except Australia, see 7.4.3. and United Kingdom) are shipped to on a DDU (Delivered Duty Unpaid) basis and all the product prices displayed are exclusive of all taxes and duties. The User from a non-EU country is liable for all import duties, customs and local sales taxes levied by the destination country.
8.4.3. Effective 1 July 2018, Australia is shipped to on a DDU (Delivered Duty Unpaid) basis and all the product prices displayed are exclusive of all taxes and duties. For shipments with a total value above AU$1,000, the user is liable for all import duties, customs and local sales taxes levied by the destination country. For shipments of AU$1,000 or less, GST (Goods and services tax) of 10% will be added to the price at checkout. Finnish Design Shop collects and pays the GST to the Australian Tax Office (ATO) in accordance with Australian legislation. The user is liable for all other import duties, customs and local sales taxes levied by the destination country.
9. Delivery
9.1. Delivery charges vary depending on the shipping destination and are stated for each order at check-out.
9.2. Delivery times vary from product to product. Delivery time is determined by the availability of the product and order destination.
9.3. Service Provider shall not be liable for delays in performing or failure to perform this Agreement or any obligations hereunder, which are directly attributable to causes beyond its reasonable control (force majeure), including, but not limited to, acts of God, fires, strikes, labor disputes, war, acts or intervention by any governmental authority, failure of a common carrier, supplier, hardware, software, browser, or communications equipment, or network failure, congestion, or malfunction.
9.4. Service Provider reserves the right to deliver different products ordered at the same time separately.
9.5. Service Provider takes responsibility for the loss and damage of the product occurred during the delivery
10. Cancellation and returns
10.1. The User (except institutions and companies) has the right to cancel their order by notifying Finnish Design Shop within 30 days of delivery. This right to cancel does not extend to products which are produced or altered according to the customer’s wishes.
The customer has a right to return a product if
1. The order has been cancelled according to the terms and conditions by notifying Finnish Design Shop within 30 days of delivery,
2. The product has not been used,
3. The product is in the condition that the customer received it in and all the parts of the product are included in the package and
4. The product has been repackaged into its original package or an equivalent.
10.2. The product must be returned immediately after cancellation.
10.3. When returning products User will be responsible for the risk of damages.
10.4. Please note that returns may be subject to a return shipping fee, which varies depending on your region and the item being returned, and will be deducted from the total refund.

Shipping costs: If you return the entire order, shipping costs paid at the time of purchase will be refunded. Returns of defective products are free of charge.
Cancellation of Interior Design Service orders and termination of the service agreement
By entering into a service agreement, the consumer expressly requests Finnish Design Shop to commence performance of the service, unless the consumer has expressly requested that performance begin at a later date.
The consumer has the right to cancel the service order within 14 days from the date the Agreement enters into force. However, the right of cancellation shall not apply if the Interior Design Service has, at the consumer’s request, been commenced before the consumer has submitted a notice of cancellation. In such cases, Finnish Design Shop shall not be obliged to refund service fees paid by the consumer in whole or in part. Any cancellation shall, in such circumstances, be subject to separate agreement on a case-by-case basis.
The customer shall notify Finnish Design Shop of any cancellation via Finnish Design Shop’s website, by email at [email protected], or by telephone at +358 20 734 3522.
If the consumer exercises their right of cancellation in accordance with the above, Finnish Design Shop shall refund all payments made by the consumer. The refund shall be made without undue delay and, in any event, no later than 14 days from the date on which Finnish Design Shop was informed of the consumer’s decision to cancel the Agreement. Finnish Design Shop shall carry out the refund using the same means of payment as the consumer used for the initial transaction, unless otherwise agreed between the consumer and Finnish Design Shop.
The service agreement shall be deemed terminated:
(i) once the service has been delivered to the customer and the customer has paid the fees in accordance with the Agreement; or
(ii) when the customer has exercised their right of cancellation as set out in these terms and Finnish Design Shop has refunded any amounts due to the customer; or
(iii) if Finnish Design Shop is unable to successfully charge the applicable service fee. In such cases, Finnish Design Shop shall promptly notify the customer that the Agreement has been deemed terminated.
11. Gift cards
Finnish Design Shop gift cards can be redeemed in the Finnish Design Shop online store. Gift cards are valid for 24 months from the date of purchase. A gift card cannot be used to purchase another gift card. You are not entitled to request the redemption of the value of a gift card in cash, nor can a lost or damaged gift card be redeemed or refunded in cash. If you cancel your order or return products that you have paid for using a Finnish Design Shop gift card, the amount paid will be refunded to your gift card and will be available for future purchases.
12. Changes to the Service and this Agreement
Service Provider reserves the right to make changes to the Service, policies, and this User Agreement at any time.
13. Jurisdiction and Settlement of Disputes
Finnish Design Shop encourages the Customer to contact Finnish Design Shop first to resolve any questions or concerns. Finnish Design Shop will make every effort to resolve such matters in good cooperation with the Customer.
This User Agreement will be interpreted, construed and enforced in all respects in accordance with the laws of the Republic of Finland. Any contractual disputes are primarily settled through negotiations, in other cases disputes are settled at the Helsinki District Court, Finland.
14. Language of this Agreement
The parties have agreed that this Agreement and related documents shall be written in English.
15. Compliance with Sanctions
15.1. The User represents and warrants that on the date of this Agreement or thereafter it complies with all sanctions that are applicable to it, or the products, including but not limited to, any economic or financial sanctions, implemented, administered or enforced by the United Nations, European Union, Finland, United States of America (including Office of Foreign Assets Control) and United Kingdom (collectively “Sanctions”). The User undertakes to notify the Supplier without undue delay if any time during the contract period the User becomes subject to Sanctions.
15.2. The User represents and warrants that the Products are intended for its own use and the User agrees that it will not resell, export, or re-export, or otherwise transfer directly or indirectly any products acquired under this Agreement to the Russian Federation, Belarus or for use in the Russian Federation or Belarus, the government of or an agency or instrumentality of the government of, or an entity owned or controlled by the government of any embargoed or restricted country, an entity in, organized under the laws of, or operating from an embargoed or restricted country or a person ordinarily resident in an embargoed or restricted country, or a person or entity subject to Sanctions or which is indirectly at least 50% owned or otherwise controlled by one or more individual or entity that are, subject to or targeted by Sanctions; or supply the products in any other manner that violates the above-referred Sanctions law and regulation or any applicable export control laws, regulations and orders.
15.3. The warranties, representations and commitments above in 15.1 and 15.2 made by the User are continuing through the term of this Agreement.
15.4. The User acknowledges and accepts that the Service Provider may use third party service providers for sanctions screening to manage risks and ensure compliance with applicable laws which may require provision of personal data to these third parties.
15.5 In case of breach of Sections 15.1 or 15.2 above, the Service Provider is entitled to, without prejudice to any other rights and remedies under the Agreement, immediately terminate or suspend the performance of the Agreement, or part thereof, or any order made thereunder at its discretion with immediate effect, without any liability to pay damages to the User. The Service Provider is also entitled to compensation for any cost, loss or damage incurred due to the breach.

COLLECTED PERSONAL DATA
Finnish Design Shop collects and processes personal data only to the extent necessary for fulfilling the purposes of use described in this privacy policy.
The collected personal data and the scope of its processing varies depending on the relationship between Finnish Design Shop and the customer or user of online services, the permissions and denials concerning the processing of personal data and marketing and the cookie and tracking settings of the browser used.

Data collected from the use of online services may include:
- data collected from the device or application used, such as browser version, device type, screen resolution, and operating system, IP address, unique device and/or cookie identifier
- data about online service use, such as information about pages loaded, time spent at online services, navigation in online services or advertising or marketing content viewed
- data about web pages opened through customer communication
- location data by country based on IP address
- data collected by social plugins or other third parties.
- A user of online services can be identified through a digital identifier created in the services when the customer signs in or arrives at the online service through targeted customer communication, such as a newsletter.

Derived and combined data
In order to serve its customers and online service users better, Finnish Design Shop refines collected personal data by analyzing it using various statistical methods and by combining data collected from different sources.
Using the aforementioned methods, it is possible to make assumptions about things such as interests, gender, age group, purchasing behavior or other similar characteristics. These assumptions are based on the submitted or collected data mentioned in the previous paragraph. In order to ensure consumers' privacy, Finnish Design Shop shall not make assumptions about information that is considered sensitive.
Finnish Design Shop secures the privacy of its customers or users of online services by exercising special care when carrying out the derivation and combination of data described above, so that the privacy of customers or users of online services is not compromised.
PERSONAL DATA PURPOSES OF USE AND THE LEGAL BASIS FOR PROCESSING

Finnish Design Shop uses customers' personal data for various activities necessary for maintaining a customer relationship, including:

SHARING AND HANDING OVER PERSONAL DATA
Finnish Design Shop utilizes personal data for implementing the purposes described above in paragraph 3 (Personal data purposes of use and the legal basis for processing). In addition, Finnish Design Shop may use third-party services, in which case Finnish Design Shop shall ensure the lawful processing of data through contractual arrangements and instruct third parties on processing data.
Finnish Design Shop may share or hand over personal data to third parties in situations including the following:

Finnish Design Shop does not generally transfer or process personal data outside the European Union or the European Economic Area. If data is exceptionally transferred outside the EU/EEA, for example to the server environments of U.S.-based service providers (such as Microsoft and Google), such transfers are carried out on the basis of the European Commission’s Standard Contractual Clauses (SCCs) or another safeguard mechanism in accordance with Article 46 of the General Data Protection Regulation.
STORING PERSONAL DATA
Finnish Design Shop stores personal data as long as is necessary for implementing the purposes defined in paragraph 3. However, valid legislation, such as accounting laws or other exigent legislation, may require the storage of personal data even after the purpose of processing has expired. In such situations, storage times defined in applicable legislation shall apply.
AN INDIVIDUAL'S RIGHTS AND WAYS OF INFLUENCING THE PROCESSING
Finnish Design Shop is committed to protecting the privacy of its customers and online service users, and to upholding the rights provided under data protection legislation. The following outlines the key rights and means of influence available to customers regarding the processing of their personal data:

Customers also have the right to lodge a complaint with the competent data protection supervisory authority in their country of residence or place of work, if they consider that the processing of their personal data infringes applicable data protection legislation.

Terms and conditions of the Finnish Design Shop customer loyalty program

1. Customer loyalty program
The customer loyalty program of Finnish Design Shop Oy (referred to as "Finnish Design Shop" in these terms and conditions) offers targeted rewards and offers to members. The customer loyalty program is valid until further notice. A member must be at least 18 years old individual.
2. Joining
Joining the customer loyalty program is free and does not obligate to purchase. Membership of the customer loyalty program is personal.
3. Personal data and marketing
Finnish Design Shop processes the personal data of the customer loyalty program’s members in accordance with the privacy policy. A member undertakes to keep their username and password confidential and is responsible for the actions taken with them.
The processing of data related to the customer loyalty program is based on the customer agreement you have entered into. In order to administer the customer loyalty program, we collect your name and contact information from you.
A member is obliged to provide the correct personal information when joining, and a member is responsible for keeping their personal information up to date. You can update your personal information in the My account section on Finnish Design Shop’s website.
A member's e-mail address serves as an identifier for the customer loyalty program. Finnish Design Shop is part of the A-Lehdet group, and personal data can be used in other companies of the group as well.
In addition, with the help of cookies, we collect information about the use of online service and purchases of the members of the customer loyalty program, as well as information provided by the members themselves, such as feedback and responses to surveys.
We can combine the collected data with other customer data, and use it to allocate current rewards, services and content to the members of the customer loyalty program, as well as for analytics, statistics and development purposes of the customer loyalty program.
Finnish Design Shop's customer loyalty program includes marketing communications. When joining the program, you agree to receiving Finnish Design Shop's current news, rewards and offers by email.
4. Rewards and offers
Members of the customer loyalty program are offered various rewards and offers on Finnish Design Shop's products and services. Offers can be one-time rewards or offers that are valid for a specified period of time. The member benefits will be visible in your account. Information about the rewards and offers is sent by e-mail and as mobile phone notifications.
A member earns one point for every product purchase of at least 100€ when identified in the Finnish Design Shop online store or showroom & shop in Turku, Finland. Each full 100€* entitles members to one point. For example, if a member makes a one-time purchase of 240€, they will receive two points.
Points are not earned for purchases under 100€. Only product purchases in connection with which the membership has been identified will contribute to the accrual. If the membership is not identified at the time of purchase, the purchase cannot be added to the purchase accumulation afterwards, and purchases made at different purchase times or receipts cannot be combined. In addition, points from different accounts cannot be combined into one account. Your points are valid for 12 months at a time starting from when you accumulate your first point. 5. Unsubscribing from the customer loyalty program
A member can unsubscribe from Finnish Design Shop’s customer loyalty program at any time without a notice period by contacting customer service. If Finnish Design Shop suspects that a member is misusing membership offers or other rewards or otherwise violates these terms and conditions, Finnish Design Shop has the right not to grant rewards and to terminate the membership.
6. Changes to the customer loyalty program
Finnish Design Shop has the right to terminate the customer loyalty program and change its terms, such as the rewards offered in the program, without separate personal notice. Changes to the terms will be communicated by publishing the updated terms on the Finnish Design Shop’s website.
